Création d'entreprise au Japon / visa Investor

Bonjour à tous,

Je vis actuellement au Japon avec un Working Holiday Visa.

Souhaitant rester vivre au Japon, et n'ayant pas les diplômes nécessaires afin de me faire employer dans une société afin d'obtenir un visa de travail.

Je souhaite ouvrir ma propre société. Je vous passerai le détail quant à la description de l'activité qui ne regarde que moi ( oui je suis un peu parano (-o-) )

je souhaite avoir des renseignements sur l'ouverture d'une Godo Kaisha a Tokyo car j'entend tout et son contraire, et même les quelques avocats que j'ai consultés semble pas d'accord...

1) Est-t'il nécessaire d'investir 5 millions de yen ET d'embaucher 2 salariés a pleins temps ? Je ne dispose pas d'un investissement de 5
millions de yens actuellement, mais il me serai facile d'embaucher 2 salariés japonais a pleins temps. est-ce suffisant ?

c'est THE question, certains disent OU, alors c'est soit l'un , soit l'autre , ou les deux, ou juste 5 millions de yen , bref, ce n'est pas clair et même les avocats ce contre-disent. (@-@)

2) j'ai lu sur certain site, que pour ouvrir une entreprise, le manager doit justifier de 3 ans d'experiences de management. est-ce vrai ?

d'après un avocat c'est faux, c'est pour les grandes entreprises que cela marche comme cela, mais j'aimerai avoir confirmation.

3) Il est dit qu'une Godo Kaisha peut-être créée avec un capital de 1yen. est-ce vrai ? ou n'est-ce que symbolique et un investissement doit être
réalisé. Sachant que ma société reposera avant tous sur l'apprentissage, et donc ne nécessitera pas de grandes dépenses de matériels.

Ne disposant que d'un visa Working holiday actuellement, je souhaite que la création de l'entreprise me garantisse un visa investitor/manager. Je souhaite donc créer mon entreprise dans l'optique du visa et aussi garantir mon avenir personnel et professionnel. Autant faire d'une pierre deux coups.

T'aurais quand même pus te lever le cul et chercher sur le forum hein...
Bon de mémoire, les 5 millions de yen c'est pas an (voir PDF qui explique les modalités). Donc déja t'es mal.
Les 1 yens c'est symbolique, tout comme la K.K depuis la loi de 2006. Mais tu dois quand même payer les frais d'avocats de l'ordre de 200,000 à 300,000 avec tout ce que ça comporte de frais notariés, de publication obligatoire à un journal. Ensuite à toi la joie des hankos etc...

Le Visa Investor/Business Manager comprends aussi celui de manager.
Donc normalement les 3 ans d'expérience dans le management ne sont pas obligatoire si tu choisis l'investor et dans ce cas, tu dois investir minimum 5 millions de yen par an.
C'est pour éviter les abus. Le Business Manager c'est celui qui va manager un business pour le comtpe d'un japonais ou autres. Donc il n'est pas l'investisseur mais celui qui va faire tourner la boite. Son

La loi, c'est 5 millions ou alors les deux permanents (Japonais ou non).
C'est pas flou et bien expliqué plus bas dans cet amendement spécial.



A savoir que rien n'oblige l'immigration à te changer ton visa si tu as déjà investis au Japon.
Plusieurs cas de gaijin ayant crée leur boite et s'étant vu refuser leur visas existe.
Le visa en lui même est très dur et long à obtenir, déjà il faut l'avoir le Business Plan à fournir à l'immigration hein.
Pour la petite histoire, j'ai participé à faire celui de mon pote-associé il y a quelques années, des emmerdes à rallonge.

Would you explain "Scale" requirements in the landing permission requirement for the status of residence "Investor/Business Manager"?

According to Ministerial Ordinance to provide for Criteria pursuant to Article 7, Paragraph 1, Item 2 of the Immigration Control and Refugee Recognition Act, a foreign national will obviously fall under the statuses of residence "Investor/Business Manager" if he/she hires or intends to hire "two or more full-time employees who are residing in Japan (except for the statuses of residence as stated in the upper column of Annexed Table I of the Act)" as stipulated in the Item 1 (b) and Item 2 (b) of the Landing Permission Requirement for the status of residence "Investor/Business Manager." However, if a foreign national does not hire two or more full-time employees, it is unsure how large the foreign national would have his/her business to qualify for the status of residence "Investor/Business Manager." In this sense, the Immigration Bureau has applicable guideline that such foreign national should "annually invest 5 million yen or more if the foreign national intends to start his/her own business." In line with the Third Report for Promotion of Regulatory Reform, the Immigration Bureau provides specific information on how to handle annual investment of 5 million yen in terms of the status of residence "Investor/Business Manager."
